Shares of Qualcomm Inc. (QCOM) are rising in Tuesday's after-hours market, following media reports the U.S. Department of Justice asked a court to hold an antitrust order that would have made the company change the way it licensed its patents.

At 5:53 p.m. ET, Qualcomm shares had gained 4.12% to trade at $78.85. Over 800,000 shares had traded in the after-hours session. The company's shares closed the day's regular session with a gain of 0.32% to finish at $75.67.

Bloomberg reported the Justice Department, citing national security concerns among others, asked the U.S. Court of Appeals in San Francisco to put a hold on the order until the company could appeal.
