The attorney general for Washington state on Monday said Johnson & Johnson Inc. (JNJ) agreed to pay $9.9 million for failing to disclose risks associated with its surgical mesh devices.

Bob Ferguson was the first state attorney general to file a suit against J&J pertaining to its surgical mesh devices, his office said.

Before the trial, which was scheduled to begin today, Johnson & Johnson agreed to the payment, which will be used to assist women who received pelvic mesh implants, Mr. Ferguson said. This is in addition to any recovery they may receive in other lawsuits.

The lawsuit, which was filed in May 2016, alleged J&J failed to include several serious, life-altering risks associated with its surgical mesh devices in materials for patients and doctors, the attorney general's office said.

A statement from Ethicon, Inc., the J&J subsidiary that produced the mesh products, said, "Ethicon is pleased to have reached a settlement with the Washington state attorney general to resolve the pending litigation. Ethicon's devices for treatment of incontinence are recognized as the standard of care by surgeons and medical professional societies in Washington and around the world. Any contrary allegations are at odds with the views of leading doctors and medical groups, as well as the FDA. We appreciate the advocacy of the Washington State medical community, many of whom publicly disagreed with the allegations in this lawsuit."
