ITEM 7.01 REGULATION FD DISCLOSURE

On August 25, 2009, JoS. A. Bank Clothiers, Inc. (the “Company”) issued a press release (the “Press Release”) in which the Company announced that it would be accelerating the pace of its new store openings in fiscal year 2010 to 30 to 40 new stores from the 10 to 15 new stores planned for fiscal year 2009. A copy of the Press Release is attached as Exhibit 99.1.
