Energy Fuels Inc. (TSX:EFR) ("Energy Fuels" or the "Company"), today announced
that motions filed by the Company and the Colorado Department of Public Health
and Environment ("CDPHE"), to dismiss a lawsuit by Sheep Mountain Alliance
opposing the Radioactive Materials License for the Pinon Ridge Mill, were denied
on May 25, 2011 by Denver District Court. 


"We were not surprised by the judge's decision to allow the lawsuit to move
forward," stated Company President and CEO, Stephen P. Antony. "It is always
difficult to get a case dismissed at this very early stage of litigation. We
remain confident that CDPHE and Energy Fuels will prevail on the merits."


This was primarily a decision addressing issues of jurisdiction and standing for
the plaintiffs. The decision by the court did not review or address any facts or
substantive aspects of the complaint.
