Under the terms of the agreement, Intervest shareholders will receive common shares of Bank of the Ozarks stock; the number of shares issued will be determined by the ten day average closing stock price as of the fifth business day prior to the closing date, with a minimum and maximum price of $23.95 and $39.91.
