(NASDAQ:COCO) has reviewed a copy of the amended class action
complaint filed by Milberg Weiss Bershad & Schulman LLP on
February 17, 2005 in the U.S. District Court, Central District of
California. The Company previously disclosed the lawsuit in a press
release and in SEC filings and continues to believe the complaint
is without merit. The Company and the individuals named in the
